Spanish labour law is strict and requires everyone who works in Spain to register with the Social Security system under one of the existing categories - without exceptions.Hiring EU personnel
Hiring members of staff from the EU is just the same as hiring local personnel. People from EU countries wishing to work in Spain must go to the local Foreigners' Office to request a foreigner's identity number (NIE). Once this number has been obtained, they are subject to the same rules as Spanish citizens. If they are self-employed professionals, they can issue intracommunity invoices to other EU countries.Hiring non-EU personnel
If a Spanish-based company wants to hire non-EU staff, then it must present the necessary documents at the office of the government delegation to the region (Delegación del Gobierno). While this temporary work permit is being processed, the worker is unable to undertake any remunerative work. If the worker is obtaining the work permit on his own account, then he should approach the office of the government delegation in the region himself (offices listed below). After a period of 90 days, he will receive a reply through the consulate of his country of origin. Once obtained, the work permit entitles the employee to be treated the same as a Spanish worker.
